Abraham-Joseph is an "unlawfully present United Kingdom national" who came to the U.S. in July 2005 on a visa that expired a year later, Cox said.

TMZ has reportedly obtained three police reports that suggest that 21 drove his red Dodge Challenger over the sidewalk in an attempt to get to another street, where he was then pulled over and ordered to drop the auto keys out the window.

Police tell TMZ that the rapper was pulled over after "driving recklessly" and was potentially going to hit a fully-marked cop auto on the day he was taken into custody on Sunday (Feb. 3). When he did, he allegedly also threw out a bottle containing an unknown substance, which was taken into evidence. The visa is available to those who have been the victims of a crime in the United States, have suffered physical or mental injury as a result of a crime and who are "helpful to law enforcement or government officials in the investigation or prosecution of criminal activity", according to ICE. Another person named Kalil Smith was also arrested, who was in the third auto carrying a M4 rifle.

Smith, who raps under the stage name SG Tip, was charged with possession of a firearm by a convicted felon and violation of street gang terrorism and prevention act.

Law firm Kuck Baxter Immigration released a statement earlier this week saying USA officials have known about Abraham-Joseph's immigration status since at least 2017 when he sought a new visa, and while that application is pending the rapper should not be subject to detainment.

He said in a statement: "In addition to being a successful recording artist, 21 deserves to be reunited with his children immediately, #Free21Savage".

The attorney hired by Jay, Alex Spiro, also released a statement to TMZ. He was convicted of drugs charges in 2014.

According to TMZ, Jay-Z said the arrest and detention of the rapper is "an absolute travesty" and points out that his US Visa application has been pending for years.

The rapper's legal team previously clarified that their client was born in London and moved to America when he was 7 years old. The rapper confirmed that he was indeed born in the United Kingdom, but came at an earlier age than what was widely reported.
