Kavanaugh Joins More Liberal Judges in High-Profile Decision

Recently, Chief Justice Roberts signaled his desire to keep the Supreme Court out of controversial territory for the sake of appearances when he publicly rebuked President Trump for calling out judicial activism from the Left.

The court's order reflected a split among its conservative justices and an accusation from Justice Clarence Thomas that his colleagues seemed to be ducking the case for political reasons.

On Monday, the Supreme Court denied appeal of two lower court rulings against state laws terminating Medicaid contracts with Planned Parenthood - leaving intact decisions that protected the provider in a victory for health care and reproductive rights activists. "But the good news is that there are other similar cases pending in lower courts, which may give the Supreme Court another opportunity to decide this important issue".

"We created this confusion".

Thomas wrote an impassioned dissent from the denial of cert because this is a risky trend we are seeing from his colleagues.

Planned Parenthood. "So what explains the court's refusal to do its job here?" "But these cases are not about abortion rights". State officials are not even safe doing nothing, as the cause of action recognized by the majority rule may enable Medicaid recipients to challenge the failure to list particular providers, not just the removal of former providers. After the videos, Louisiana and Kansas moved to block people from using Medicaid funds for Planned Parenthood services.

Thus, anything conservatives ever want to accomplish, even if they win elections, is essentially dead on arrival because of lower court judges allowed to reign supreme.

The new case Kisor v. Wilkie involves the Department of Veterans Affairs, and asks the court to reexamine its 1997 decision in Auer v. Robbins, which said courts should defer to an agency's interpretations of its own regulations. Abortions accounted for 3% of the medical services Planned Parenthood provided in 2016, the group said. "The pro-life grassroots will not stop fighting until every single tax dollar is untangled from the abortion industry". Planned Parenthood of Gulf Coast. "As a doctor, I have seen what's at stake when people can not access the care they need, and when politics gets in the way of people making their own health care choices", said Dr. Leana Wen, the group's president.

Johnson told CNA she believes states should instead fund federal qualified healthcare clinics, which "outnumber Planned Parenthood almost 20-to-1 and sees ten times the number of patients that Planned Parenthood does every year". The money is not used for abortions. And for low-income women, this health care can be paid for through Medicaid. The decision is a blow to conservative lawmakers who've tried to defund the organization and other abortion providers for years.

But lawyers for Planned Parenthood and their patients have gone to federal courts and won rulings blocking most of these laws from taking effect. In response, PPGC sued in federal court, alleging that Louisiana had deprived three anonymous co-plaintiffs of their federal statutory right to "to choose to receive their medical care from any qualified and willing provider". Abortion rights groups maintain that the Daleiden videos were edited to be misleading, and Planned Parenthood later sued his group.
