Hero or villain? Trump's court pick is in for a fight

President Trump plans to nominate Brett Kavanaugh to the U.S. Supreme Court to fill the vacancy left by retiring Justice Anthony Kennedy.

The director did not mention how Mr. Kavanaugh's 12 years on the USA appeals court failed to draw the attention of doomsday activists until now.

"No investigation of a president!" "What matters is not a judge's political views but whether they can set aside those views to do what the law and the Constitution require".

"If the president does something dastardly, the impeachment process is available", he wrote.

In an interview July 10, Senate Democratic Leader Charles Schumer suggested the comment about presidential power by Kavanaugh could give Trump a pass in the investigation, even though it came long before Mueller's investigation into Russian interference in the 2016 election. And for Democrats, it makes more sense than making poor Heidi Heitkamp and Joe Donnelly walk the plank and vote against Kavanaugh even if his confirmation is assured.

That service led to top posts in President Bush's White House as a lawyer and as staff secretary, the clearinghouse official who handles virtually every important document the president touches. Eddie Bernice Johnson of Dallas and Lloyd Doggett of Austin - also expressed grave concerns about statements Kavanaugh made regarding investigations and indictments of sitting presidents. In 2003, he served as Assistant to the President as the White House Staff Secretary, according to SCOTUS Blog.

Collins, a moderate Republican, has generally supported court nominees put forth by Republican presidents.

NOM and other conservative groups have launched massive lobbying operations in favour of Kavanaugh, who was vetted by the anti-LGBT Heritage Foundation and Federalist Society, both of whom have strongly opposed anti-discrimination protections for LGBT people.

He is now a United States Circuit Judge of the United States Court of Appeals for the D.C. Circuit.

Schumer said that Kavanaugh "has said the president shouldn't be investigated".

Pence himself inadvertently added to those concerns on Tuesday, when asked whether he still supported overturning Roe v. Wade. Conservative writer Phil Klein wrote Tuesday in The Washington Examiner: "It's worth cautioning that how Kavanaugh ruled at the appellate court level may not be an indication of how he would have ruled were he on the Supreme Court in 2012. the nuance of his opinion contains some positive signs and makes any sort of firm conclusions hard to draw".

"Judge Brett Kavanaugh represents a direct and fundamental threat to the promise of equality" and to "the health care of hundreds of millions of Americans", said Sen. "A judge must interpret statutes as written and a judge must interpret the Constitution as written, informed by history and tradition and precedent".

Outside Trump Tower in Midtown, demonstrators gathered to protest the potential shift of the Supreme Court to the right.

Sarah Kate Ellis, President and CEO of GLAAD, said: "If confirmed, Brett Kavanaugh will have the chance to codify President Trump and Vice President Pence's risky anti-LGBTQ record and the agenda of anti-LGBTQ groups into law for decades to come". "Let's be clear: a vote for Kavanaugh would be a vote to rip health care from American families and deny women their constitutional right to make their own health care decisions".

One measure of a judge's influence is how many of his clerks wind up working in the Supreme Court.

Kennedy has often been the crucial swing vote on the nine-vote court in favour of LGBT equality, authoring rulings in 2003, 2013 and 2015 that invalidated sodomy laws, struck down anti-gay legislation, and introduced equal marriage in all 50 states.
